Belarus simplifies the procedure for state registration of scientific research, experimental design and experimental technological work

By decree of the Head of State dated November 28, 2016 No. No. 430, amendments were made to the Regulation on the procedure for state registration of scientific research, experimental design and experimental technological work, approved by the Decree of the President of the Republic of Belarus of May 25, 2006 No. No. 356.

It was determined that the state registration of research, development and experimental-technological works (NIOK (T) R) is carried out according to the results of their departmental scientific and technical, and (or) state scientific, and (or) state scientific and technical expertise, carried out by departmental scientific and technical expert councils or state expert councils within the framework of the functioning of a unified system of state scientific and state scientific and technical expertise.

Departmental scientific and technical expertise is carried out:

republican government bodies and other government organizations subordinate to the Government, the National Academy of Sciences of Belarus – in relation to NIOC (T) R carried out by organizations subordinate to (part of) these bodies and organizations, as well as business companies, shares (shares in statutory funds ) which are in state ownership and transferred to the management of the republican government bodies and other state organizations;

State Committee on Science and Technology – in relation to NIOC (T) R of other applicants, including individual entrepreneurs.

NIOC (T) R that have passed the state scientific and (or) state scientific and technical expertise are not subject to additional departmental scientific and technical expertise.

NIOC (T) R that have passed departmental scientific and technical expertise in the formation of plans for scientific research and development of national and (or) sectoral purposes, aimed at scientific and technical support of the activities of state bodies, as well as funded from the funds of innovation funds in the manner prescribed by the President of the Republic Belarus, repeated departmental scientific and technical expertise (after the conclusion of contracts with the executing organization or the publication of other documents, including regulatory documents, which are the basis for the performance of work and determine the relationship between the executing organization and the customer) are not subject.

The state registration of NIOC (T) R, as well as the maintenance of the state register of NIOK (T) R and organizational and technical support for the use of information resources of the named register are carried out by the state institution “Belarusian Institute for System Analysis and Information Support of Scientific and Technical Sphere” (BelISA).

The document defines the algorithm for state registration of NIOC (T) R.

The deadline for sending registration documents by the executing organization to BelISA has been increased from one to two months from the date of the conclusion of an agreement for the implementation of NIOC (T) R (issuing an order from the head of the executing organization on the performance of work by a structural unit of such an organization). If the documents are not submitted in full, they must be returned within three days with justification of the reasons for the return.

Within 20 working days, the received documents are considered, the content of the contract for the performance of work or other documents, including administrative ones, which are the basis for the performance of work and determine the relationship between the executing organization and the customer, in terms of the schedule are analyzed, and the state registration of the work is carried out.

Notification of the inclusion of NIOC (T) R in the state register is sent to the executing organization within 5 working days.

The basis for refusal of state registration is the presence of a negative conclusion of the departmental scientific and technical and (or) state expert councils. This decision is made by BelISA within 10 working days after the receipt of the documents.

Control over the state registration of NIOC (T) R is carried out by the State Committee for Science and Technology. The department also determines the procedure for using the state register for the analysis, systematization and substantive search of the information contained in it, including at the request of interested parties, as well as access to information contained in the information resources of the register, when conducting departmental scientific and technical and (or) state scientific and (or) state scientific and technical expertise within the framework of the functioning of a unified system of state scientific and state scientific and technical expertise.

In addition, the SCST summarizes the information received from BelISA on the state registration of NIOC (T) R and annually until March 15 presents them to the Government, which, in turn, informs the President of the Republic of Belarus about the results of state registration by April 1.

It was established that the implementation of administrative procedures for the state registration of NIOC (T) R on applications accepted before the entry into force of the Decree is carried out in accordance with the procedure in force on the date of acceptance of these applications.
